THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20531 OF 2017 ORDER:

This writ petition is filed seeking to issue a writ of mandamus to declare the action of the 4th respondent in not taking steps to remove the illegal and unauthorized construction made in land admeasuring Acs.3.14 cents in Sy.No.364, situated at Narasaraopet within Vinukonda Municipality, Vinukonda Mandal, Guntur District, though the said property belongs to the petitioner society which is in the list of the prohibited lands inspite of the written complaint, dated 12.05.2017, as illegal and arbitrary.

Heard and perused the material available on record. The petitioner is the American Baptist Foreign Mission Society. The petitioner has possessed an extent of Acs.3.14 cents of land in Sy.No.364 at Narasaraopet, Vinukonda Mandal, Guntur District. In the recent past, some unconcerned persons have attempted illegal claims over the said property without any right and erected sheds. The petitioner made written complaint to the 4th respondent. But, no action has been taken so far.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:

" The 4th respondent is directed to consider the complaint, dated 12.05.2017, made by the petitioner, and take appropriate action in accordance with law regarding the alleged unauthorized constructions,

within a period of eight (8) weeks from the date of receipt of a copy of this order."

With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending if any, shall stand closed.
