HON'BLE SRI JUSTI CE P. KESHAVA RAO W RI T PETI TI ON No.2 2 8 8 4 of 2 0 1 4 ORDER:

There is no representation on behalf of the petitioner. 2.

The prayer sought in the writ petition is as under: "...this Hon'ble Court may be pleased Issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents Nos.3 to 5 in not taking legal action against the respondent No.6 as per law by registering FIR under various Penal provisions of Indian Penal Code is arbitrary and illegal and consequently issue a direction to the respondent No.3 to 5 to take action against the respondent No.6 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

3.

The learned Government Pleader appearing for the respondents 1 to 3 placed on record the written instructions dated 14.08.2014 issued by the Sub-Inspector of Police, Velgatoor Police Station, Karimnagar District.

4.

From a perusal of the said written instructions, it is revealed that the respondent No.3 assumed the charge as Station House Officer, Velgatoor Police Station on 22.01.2014 and as per the Station records, the present written instructions are furnished. On receipt of the communication about the filing of the present writ petition, the respondent No.3 has thoroughly verified the records of the police station as to whether the petitioner has lodged the complaint dated 10.08.2013. As on the date of filing of the written instructions, the Station records reveal that they have not received the complaint of the petitioner. It is also further mentioned that if the petitioner approaches the police station with a complaint, necessary action will be taken in accordance with law.

5.

When the petitioner failed to file any complaint before the respondent No.3, he cannot expect the respondent No.3 to register a crime. In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. As a sequel thereto, pending miscellaneous petitions, if any, shall stand dismissed. There shall be no order as to costs.
