THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38446 of 2016 ORDER:
This writ petition is filed seeking to call for records in FIR No.306 of 2016 and to quash the same.
Heard and perused the material available on record. The main grievance of the petitioner is that the 4th respondent lodged a written complaint, dated 12.09.2016, to the 2nd respondent alleging that she is working as a teacher in HRD School at Devarakonda, during the time of her tenure the petitioner, who is working as School Office Assistant received a sum of Rs.1,00,000/- from her and that she kept her land documents and gold in the hands of the petitioner and when she approached to take back them, the petitioner refused to return the same and thus, the present complaint is lodged for cheating the 4th respondent. On receipt of the complaint, the 3rd respondent registered the same as FIR No.306 of 2016 for the offences punishable under Section 420 IPC against the petitioner.
Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in FIR No.306 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. The petitioner is directed to report before the 3rd respondent daily between 10.00 a.m. and 5.00 p.m. for a period of ten (10) days. The petitioner is further directed to execute a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with one surety to the satisfaction of the 3rd respondent as surety for his future appearance as and when required for the purpose of investigation.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 9th November, 2016 KL
