THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10815 of 2016 ORDER:
Challenge in this writ petition is to the order dated 10.02.2016 passed by the Special Deputy Collector (Tribal Welfare), Bhadrachalam, in L.T.R. Case No.60/2015/ASPT. Perusal of the order itself indicates that an appeal lies therefrom to the Additional Agent to the Government (Project Officer), I.T.D.A., Bhadrachalam. Though Sri K.J.V.N. Pundareekakshudu, learned counsel for the petitioner, would contend that the order is lacking in jurisdiction and that notice has not been served upon his client, he is unable to demonstrate before this Court any patent lack of jurisdiction. The attempt of the learned counsel appears to be directed at the merits of the matter in terms of there being no transfer, warranting exercise of jurisdiction by the Special Deputy Collector (Tribal Welfare), Bhadrachalam.
Such aspects can be addressed by the petitioner before the appellate authority and there is no reason why an efficacious alternative remedy of appeal should be circumvented. This Court therefore sees no reason to exercise its extraordinary jurisdiction under Article 226 of the Constitution in the present case. The writ petition is accordingly dismissed. This order shall however not preclude the petitioner from availing the appellate remedy in accordance with law.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
