HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.9624 of 2011 ORDER:

Heard K.Sitaram for petitioners and the learned Assistant Government Pleaders for Revenue and Assignment. The petitioners pray for the following relief :- " .... to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in trying to distribute house site pattas in Ac.0-18 cents in Sy.No.187/ A1 of Vandavagili village of Holagunda Mandal, Kurnool District, which is earmarked for common usage and lung space, as illegal, arbitrary and violative of layout approval rules and consequently direct the respondents not to distribute house site pattas in the said land ......" .

The petitioners being the beneficiaries of house plots granted in the very same lay out, complain against the proposed action of respondents in changing the available plots into small plots and further saying that no eligible members of the village belonging to BC and SC communities were available. To the pointed query of the Court whether the petitioners are also beneficiaries of plots in the same layout, which was prepared pursuant to land acquired by the Government, Mr.K.Sitaram fairly states that the petitioners are also allotees of house site plots from Government.

On the other hand, it is informed by the Assistant Government Pleader that the petitioners are encroac hers of plots allotted to third parties.

In the above facts and circumstances of the case, this Court is not persuaded to examine the grievance of division and allotment of plots to ineligible persons by respondents. The writ petition fails and is accordingly dismissed. No order as to costs.
