HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.16588 of 2019 ORDER:

This Writ Petition is filed seeking to declare the action of respondent No.3 in not passing any order on the stay petition or in the appeal, viz., Case No.TW B2/107/2004 filed by the petitioners as illegal and arbitrary and consequently, to direct respondent No.3 to dispose of the said case expeditiously.

Learned counsel for the petitioners submits that as many as three times, respondent No.3 issued notices for enquiry under the provisions of Sub-section (1) of Section 3 of the A.P. Scheduled Areas Land Transfer Regulation, 1959 as amended by Regulation 1 of 1970, but no action has been taken thereon and therefore, seeks a direction to respondent No.3 to complete the enquiry and pass orders thereon expeditiously.

The grievance of the petitioners is that due non-completion of the enquiry by respondent No.3, the revenue authorities are not issuing title deeds to them in respect of the subject lands. Heard learned Government Pleader for Tribal Welfare appearing for respondent No.3.

Since the relief sought by the petitioners in this Writ Petition is innocuous, the Writ Petition is disposed of directing respondent No.3 to conclude the enquiry in accordance with law, if not already done, pass appropriative orders and communicate the same to the petitioners within a period of two months from the date of receipt of a copy of this order.

Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
