THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.9227 of 2004 Between:

Madduri Shivappa PETITIONER AND 1.

The District Collector, Mahaboobnagar, and others. RESPONDENTS

ORDER:

This writ petition was filed challenging the high-handed action of the respondents in laying roads, drainages etc., under a slum clearance scheme without acquisition, across the land of the petitioner of an extent of Ac.7.39 1⁄4 guntas situated in Sy.No.1032 to 1034 of Mhaboobnagar town, as illegal and arbitrary.

Since the learned counsel for the petitioner Sri E.V. Bhageeratha Rao expired, a notice was issued by the Registry to the petitioner. Though the said notice was served on the petitioner, he did not choose to engage any counsel so far. In the circumstances, it is assumed that the petitioner is not interested in prosecuting the writ petition. Therefore, the writ petition is dismissed for nonprosecution. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed.
