THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9354 OF 2015 ORDER:
This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.8 seeking grant of anticipatory bail in crime No.494 of 2015 on the file of the Madhapur (Guttala) Police Station, Cyberabad, registered for the offences under Sections 302, 201, 404, 120-B IPC read with Section 34 IPC.
Heard and perused the material available on record. The allegation against the petitioner herein is that the petitioner and the other accused hatched a plan and accordingly killed the deceased. The main contention raised by the learned counsel for the petitioner that the petitioner's name was not found place in F.I.R. It is true that in the F.I.R., some unidentified persons killed an unidentified person, but the investigation reveals through examination of witnesses that the deceased was taken in an auto to a place, where he was killed and it is also the case that A.3 took the mobile phone of the deceased and handed over the same to A.8, the petitioner herein. Considering the facts and circumstances of the case, this Court is of the view that it is not a fit case to grant anticipatory bail to the petitioner herein. Hence, this Court is not inclined to grant anticipatory bail to the petitioner herein. The criminal petition is accordingly dismissed.
