This petition is filed by the petitioner-accused under Section 482 Cr.P.C. to quash the proceedings in C.C. No.57 of 2016 on the file of the Special Judl. Magistrate of I Class for trying P & E Cases, Machilipatnam, wherein cognizance was taken for the offence punishable under Section 138 of the N.I. Act.

Heard learned counsel for the petitioner-accused and perused the record.

It is evident from the record that the Court below after following the due procedure, had taken cognizance against the petitioner-accused for the offence punishable under Section 138 of the N.I. Act. There is no infirmity in taking cognizance. There is no miscarriage of justice. The petition is devoid of merit and is liable to be dismissed. 4.
Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending in this petition shall stand closed.
