HON'BLE SRI JUSTICE S.V. BHATT W.P. No.12146 OF 2016 ORDER:

The petitioner prays for the following relief: "...Writ of Mandamus declaring the action of the 2nd respondent in not disposing of the appeal pending on his file since 2014 as illegal, arbitrary, unconstitutional and contrary to Law and consequently direct the 2nd respondent herein to dispose of the appeal pending on his file since 2014..."

Neither the petitioner nor the respondents are in a position to state the present stage of the appeal said to have been filed by the petitioner. As the writ petition is pending for quite some time before this Court, after taking totality of the circumstances including the inaction complained in disposing of the appeal, I am satisfied that the writ petition can be disposed of by this order: The 2nd respondent is directed to consider and dispose of the appeal filed by the petitioner within three months from the date of receipt of a copy of this order, if the appeal is not already heard and disposed of. The petitioner is given liberty to file copy of this order along with a memo by enclosing the appeal said to have been filed by the petitioner within two weeks from today. The writ petition is disposed of accordingly. No order as to costs.
