THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No. 26581 of 2015 ORDER:

This writ petition is filed seeking a writ of mandamus declaring the action of the respondents in not paying the amount for the work done part together with refunding the E.M.D and other deposits made by the petitioner in respect of the work contract vide L.S.Agreement No.52/2012-13/SE/R&B/KMM, dt. 06-03-2013 of the 3rd respondent as illegal, arbitrary and contrary to law; and consequently to direct the respondents to pay the entire amount payable for the work done while refunding the amounts deposited by the petitioner in respect of the said contract work to the petitioner forthwith.

2. Heard Sri V. Sree Ranga Rao, learned counsel for the petitioner and learned Government Pleader for Roads & Buildings and considered the material on record.

3. When the matter is called, it is submitted by the learned counsel for the petitioner that for the redressal of the grievances of the petitioner, the petitioner submitted representations on 07.03.2015 and 20.04.2015 to the Engineer in Chief - 2nd Respondent herein, which are pending consideration. The learned counsel requests this Court to dispose of the writ petition itself with a direction to the 2nd Respondent to pass appropriate orders on the representations of the petitioner within a time frame.

4. In view of the above, without expressing any opinion on the merits and demerits of the mater, the writ petition is disposed of with a direction to the 2nd respondent to take appropriate action on the representations said to have been submitted by the petitioner herein and pass appropriate orders within a period of three months from the date of receipt of a copy of this order. As a sequel thereto,
