THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.2589 of 2016 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C. challenging the order dated 28.09.2016 passed in Crl.M.P.No.2003 of 2016 in C.C.No.210 of 2014 on the file of the Court of III Special Magistrate at Hasthinapuram, Ranga Reddy District.

The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal revision case with liberty to file a fresh petition under Section 70 (2) Cr.P.C. in person before the trial Court to recall the Non-Bailable Warrant issued against him.

Permission is granted.

Hence, the Criminal Revision Case is dismissed as withdrawn granting the liberty as prayed for. However, the trial Court is hereby directed to dispose of the petition, if any, filed by the petitioner/accused under Section 70 (2) Cr.P.C. on the same day in accordance with law.
