HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.739 of 2017 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to quash the proceedings against them in Crime No.236 of 2016 on the file of the Central Crime Station, Hyderabad. 2.

Heard and perused the material available on record. 3.

It is stated in the affidavit that the above crime was registered for the offence under Sections 420 and 406 IPC alleging that the 6th respondent had given some gold jewellery to Bipin Jain, who is the owner of Sri Karma Jewels on credit basis, and the said Bipin Jain promised to pay the amount within short time. But he failed to pay the same. Subsequently, he was found absconding, and his family members informed that he is missing. It is the case of the petitioners that the said Bipin Jain is the son of the 1st petitioner and that the petitioners are no way concerned with the business transaction of the said Bipin Jain and that there are no allegations against them. But the petitioners were implicated in the above crime. 4.

The petitioners filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation in the above crime. However, the official respondents are directed to complete the investigation and file a final report, in accordance with law, without arresting the petitioners. The petitioners are directed to appear before the Station House Officer concerned daily in between 9 a.m., and 5 p.m., for a period of one month and they are also directed to execute a personal bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with one surety each for the like sum each to the satisfaction of the

Station House Officer concerned, as surety for their future appearance as and when required for the purpose of investigation. 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 5th January, 2017.
