HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.24106 OF 2016 ORDER:

Heard.

2. The case of the petitioner is that he is the owner and possessor of plot to an extent of Ac.0-05 cents in Survey No.4904-1, Ac.0-05 cents in Survey No.49-2 and Ac.0-10 cents in Survey No.494-3-A-2 of Vedurupavuluru Village, Gannavaram Mandal, Krishna District. While so, the 5th respondent started survey and demarcation of the land for laying the bye-pass road from Mustabad to Savarigudem with the help of the 3rd respondent. The 3rd respondent along with staff entered into the subject property and started demarcation through the subject land without following due process of law. Questioning the action of the respondents, petitioner has approached this Court by this writ petition.

3. Both the learned counsel fairly submits that this writ petition is similar to the one considered by this Court in W.P.No.24467 of 2016, which was disposed of on 25.07.2016.

4. Following the same, this Writ Petition is disposed of directing the respondents to carry on the survey and demarcation exercise of the property, in question, only after issuing prior notice to the petitioner and by following the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. As a sequel, the miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
