HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36686 OF 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleaders for Revenue. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself.
The present Writ Petition came to be filed seeking to declare the action of the second respondent in not taking action for removal of encroachments on the cart tract leading from National Highway NH-9 to lands in Survey Nos.308 and 309 of Zaheerabad Village and Mandal, Medak District, as illegal and arbitrary.
Though various grounds are raised in the Writ Petition, learned counsel for the petitioner restricts his prayer seeking a direction to the second respondent to dispose of the representation dated 14.10.2015, made by the petitioner, seeking removal of encroachments made in the subject land. Learned Government Pleader for Revenue submits that the said direction may be given provided the application is still pending consideration. Without going into merits of the case and having regard to the circumstances stated above, the present Writ Petition is disposed of advising the second respondent to dispose of the representation dated 14.10.2015, made by the petitioner, seeking removal of encroachments made in cart tract leading from NH-9 to the lands of the petitioner in Survey Nos.
308 and 309 of Zaheerabad Village and Mandal, Medak District, within a period of eight (08) weeks from the date of receipt of a copy of the order, in accordance with law, if the same is still pending consideration. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall also stand closed.
