THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.29835 of 2017 ORDER:

This Writ Petition is filed challenging the action of the respondents in not considering the representation for giving the benefits of land pooling scheme to the petitioner firm for the land in an extent of Acs.4.24 cents in Survey No.121 of Mandadam Village and not considering the land as Gramakantam in an extent of Ac.0.401⁄4 cents in Survey No.119 of Mandadam Village, Thullur Mandal, Guntur District. This Court, by an order dated 30.08.2017, in a batch of writ petitions, i.e., W.P.No.7016 of 2017 and batch, which are identical to the present writ petition, partly allowed the writ petitions setting aside the declarations published under Section 19(1) of Act 30 of 2013 and giving liberty to the petitioners to raise objections under Section 15(2) of Act 30 of 2013. The learned Counsel appearing for the respondents does not dispute the same.

In view of the same, this writ petition is also partly allowed setting aside the declaration dated 20.07.2017 in so far as the land of the petitioner is concerned. The petitioner is given liberty to file comprehensive written objections in accordance with Section 15(2) of Act 30 of 2013, within two weeks from the date of receipt of a copy of this order and the Collector shall consider the said objections and deal with said objections thoroughly and pass a reasoned order considering the

objections raised by the petitioner within a period of four weeks thereafter. It is needless to observe that at the time of considering the objections, the objectors shall be heard either in person or through their counsel.

Consequently, miscellaneous petitions, if any, pending in these writ petitions shall stand closed. There shall be no order as to costs.
