HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Petition No.545 of 2011 ORDER:
This Criminal Petition under Section 482 of the Code of Criminal Procedure (for short 'Cr.P.C.') is filed by petitioners-A1 and A2 seeking to quash the proceedings in F.I.R. No.237 of 2010, dated 2012-2015 on the file of the Madanapalle I Town Police Station, Chittoor District, registered for the offences punishable under Sections 323, 354, 498-A and 406 I.P.C.
The F.I.R. in this case was registered on the basis of reference made under Section 156(3) Cr.P.C. by the learned Magistrate. When the matter is taken up for hearing, the learned counsel for petitioners and the learned counsel for the Respondent No.2 informed that now the de facto-complainant also joined with the petitioner No.1, who is none other than father-in-law of the de facto-complainant and also the petitioner No.2, who is the wife of the petitioner No.1 and the son of the petitioner No.1 also joined with the petitioner No.1 and they are living together. The learned counsel for the respondent No.2 also informed that the de facto-complainant is not having any grievance against petitioners herein and also informed that the proceedings in F.I.R. No.
237 of 2010, dated 20-12-2015 on the file of the Madanapalle I Town Police Station, Chittoor District, against petitioners herein can be quashed. Considering the facts and circumstances of the case and also the material placed on record, this Court is of the view that proceedings against petitioners herein in F.I.R. No.237 of 2010 can be quashed. Accordingly, the Criminal Petition is allowed and the proceedings against petitioners-accused Nos.1 and 2 in F.I.R. No.
