THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7965 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking following relief:

"to issue writ of Mandamus declaring the action of the 3rd respondent threatening the petitioner herein to return the advance amount to the 4th and 5th respondents vide agreement of sale dated 26-08-2010 which stands cancelled and barred by limitation at their instance as illegal and violative of petitioner's right under Article 14, 19 (1)(g), 21 and 300A of the Constitution of India."

When the matter is called today, written instructions furnished by the Inspector of Police, I Town Police Station, Ananthapur - third respondent herein have been placed on record by the learned Government Pleader for Home. In the said written instructions the third respondent completely pleads ignorance of civil disputes pending between the petitioner and respondent Nos.4 and 5. The said instructions further say that the third respondent never summoned the petitioner to the Police Station nor influenced him to settle the issue amicably with the respondents 4 and 5. The said instructions further deny summoning of the petitioner to the Police Station on 21-03-2015 also. It is also stated that the Police is doing job impartially and honestly and there are no adverse reports against the respondent police. It is further stated that the third respondent has no necessity to harass the petitioner to interfere with the civil disputes. It is also stated that the respondent police never interfered with the civil disputes relating to the agreement of sale, dated 26-08-2010.

In view of the above written instructions furnished by the Inspector of Police, Ananthapur I Town Police Station, this Court deems it appropriate to record the said instructions, wherein it is stated that the third respondent herein is not interfering with the civil disputes between the petitioner and the respondents 4 and 5. This order however does not come in the way of the respondents acting, in accordance with law.

With the above observation, the writ petition is disposed of. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
