THE HONOURABLE SRI JUSTICE P.NAVEEN RAO Writ Petition No.16543 of 2019 ORDER:

The petitioners claim as Inamdars of land measuring Ac.0.15 gts., and Ac.1.13 gts., in Sy.Nos.708 and 713 situated at Elgandal Village, Karimnagar District.

This land was taken possession by the Government for construction of Lower Maner Dam Reservoir. At the time of finalizing the acquisition proceedings, as no evidence was placed before the competent authority on the claim that Inam Patta was granted and they are the Inamdars, the acquisition proceedings were deferred and possession of the land was taken over by the Government.

In the year 1992, Land Acquisition proceedings were finalized and awards were passed. Some of the land losers contested the amount determined towards the land lost by them and the matter was referred to the civil Court in O.P. No.92 of 2004 and orders were passed enhancing the compensation.

From the letter of Special Deputy Collector dt.27.01.2000, assuming such letter is part of the revenue record, it appears photo copies were presented as evidence of alleged assignment Patta granted to them. Based on the said certificates, recommendation was made to the Special Collector to consider the request for grant of compensation. 5.

It appears that the matter was not pursued thereafter now this Writ Petition is instituted. In other words, petitioners are claiming

PNR,J W.P.No.16543 of 2019 compensation based on land acquisition proceedings culminating in passing award in January, 1992, after a lapse of 27 years. 6.

The petitioners ought to have been diligent at least after the recommendation was made by the Special Deputy Collector, Land Acquisition on 27.01.2000, but they kept quiet thereafter also, for 19 long years. This writ petition is liable to be dismissed on the ground of delay and latches in prosecuting their claim. 7.

In the result, this Writ Petition is dismissed. There shall be no order as to costs.

As a sequel, miscellaneous applications if any pending, shall stand closed.
