THE HONB'E SRI JUSTICE CHALLA KONDANDA RAM WRIT PETITION No.12010 OF 2017 ORDER:

The writ petition is filed challenging the inaction of the respondents 1 to 4 upon the complaints of the petitioner dated 21.02.2017 and 23.03.2017, made against the illegal and unauthorized construction being made by the 5th respondent in the premises bearing H.No.8-4-544/M/63, New Sultan Nagar, Erragadda, Hyderabad.

It is the case of the petitioner that the 5th respondent is making constructions in violation of the sanctioned plan and thereby causing injury to the petitioner's right. Petitioner claims that she is a neighbour of the 5th respondent and further on account of the constant work in day and night of the 5th respondent in construction of the building premises, the petitioner and the petitioner's children who are studying L.K.G and U.K.G are being disturbed. In that connection, petitioner submitted the complaints dated 21.02.2017 and 23.03.2017 to the respondent authorities, but the respondent authorities did not take any steps, so far. Hence, the present writ petition.

Sri P. Kesava Rao, learned standing counsel, appearing for the respondents 2 to 4, on instructions, submits that on 03.04.2017, notices have been issued to the 5th respondent under Section 452(1) of the Hyderabad Municipal Corporation Act, 1955, and action has already been initiated against him.

In the circumstances of the case and in view of the submission made by the learned standing counsel, the writ petition is disposed of directing the respondent authorities to take appropriate action against

the 5th respondent, in accordance with the law within a period of four weeks from the date of receipt of copy of the order, if the 5th respondent is making any constructions in violation of the sanctioned plan. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand disposed of as infructuous. ___________________________ CHALL KODANDA RAM,J Date:06.04.2017 Note:
