HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.16529 of 2019 ORDER:
This Writ Petition is filed seeking to issue a writ of Mandamus declaring the action of respondent No.6 in not investigating and filing charge sheet in FIR.No.95 of 2017, dated 23.10.2017, as illegal and arbitrary.
Learned Assistant Government Pleader for Home produced the written instructions before this Court, wherein it is stated that after completion of investigation in the said crime, the charge sheet is filed before the learned Judicial Magistrate of First Class, Alampur, vide C.C.No.32 of 2019 and the same is coming up for appearance of the accused on 03.10.2019.
The same is not disputed by the learned counsel for the petitioner.
Recording the above contents in the written instructions and since the grievance of the petitioner stood redressed, the Writ Petition is disposed of.
However, at this stage, learned counsel for the petitioner submits that the petitioner has made one more complaint, which was registered as FIR.No.44 of 2019. He seeks a direction to the respondents Police to take steps for investigating into the said case and filing of charge sheet. As the direction sought by the petitioner is innocuous in nature, the respondents Police are directed to investigate
and file charge sheet in F.I.R.No.44 of 2019 as expeditiously as possible keeping in view the mandate in Section 173(1) Cr.P.C. As a sequel, Miscellaneous Petitions, if any, pending shall stand disposed of. No order as to costs.
