HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14042 OF 2018 O R D E R :
The case of the petitioner is that he is working as Additional Assistant Engineer/Civil in the respondent Corporation at Ibrahimpatnam for the last 21 years and he is fully eligible for promotion to the post of Assistant Executive Engineer/Civil as per Clause (iv) of Annexure III at page 192 of APSEB Service Regulations Part III, as he has put in a total service of 15 years in the cadre of Sub-Engineer and Addl. Assistant Engineer as on 10.03.2012. While so, the Corporation filled up 11 posts of Assistant Executive Engineers/Civil by promotion.
As per Regulations for filling-up of 11 posts of Assistant Executive Engineers/Civil, 9 posts were to be allocated for Assistant Engineers and two posts were to be allocated for Additional Assistant Engineers in the ratio of 4 : 1. But the respondent Corporation without following the said ratio filled up all the 11 posts with Assistant Engineers/Civil, without earmarking any post for Additional Assistant Engineers/Civil, ignoring petitioner's candidature. As such, the petitioner made representation dated 21.02.2018 to the 1st respondent. As the same is not being disposed of present writ petition is filed.
Heard learned counsel for the petitioner and Sri N.Siva Reddy, learned Standing Counsel for respondents 1 to 3.
Having regard to the aforesaid facts and circumstances, the respondents are directed to consider the case of the petitioner, as and when they take a decision for making further promotions, in accordance with Regulations.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
