HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No.538 of 2016 ORDER :

This writ petition is filed by the petitioner seeking Mandamus to direct respondent No.4 - Sub-Inspector of Police, Banjara Hills Police Station, Banjara Hills, Hyderabad, not to interfere in civil disputes by threatening to evict the petitioner from the residential house bearing H.No.8-2-684/4/100/10, Road No.12, NBT Nagar, Narasimha Swamy Kaman, Banjara Hills, Hyderabad, at the instance of respondent Nos.5 and 6.

Learned counsel for the petitioner is not present and there is no representation on her behalf. Heard learned Assistant Government Pleader for Home and perused the material on record.

Learned Assistant Government Pleader for Home submits that respondent No.4 has filed counter affidavit stating that he has not threatened the petitioner to evict from the house in question and hence sought for dismissal of the writ petition.

It is to be noted that interim order has already been granted by this Court on 06.01.2016 directing the police authorities not to call the petitioner to the police station in connection with her vacating the subject residential property

GSP,J W.P.No.538 of 2016 unless any crime has been registered in connection therewith and even if so, to follow the procedure prescribed by law and the said order holds good.

In view of the same, the interim order dated 06.01.2016 passed by this Court is made absolute and the respondents - police authorities are directed not to call the petitioner to the police station in connection with her vacating the subject residential property unless any crime has been registered in connection therewith and even if so, to follow the procedure prescribed by law strictly.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
