THE HON'BLE SRI JUSTICE S.V.BHATT CONTEMPT CASE No.1483 of 2016 ORDER:

Heard Sri V.Srikantha Rao for petitioner and Sri V.Raghu for respondent.

The Contempt Case is filed complaining disobedience of order in W.P.No.8336 of 2013, dated 27-03-2015. On receipt of notice, the respondent filed counter affidavit and a few annexures in support of the action taken by him and also communication addressed to petitioner in this behalf.

Prima facie, I am satisfied with the reply given by respondent in the counter affidavit and this Court is also of the view that the stand of respondent in the counter affidavit is excerpted hereunder to enable the petitioner to get the benefit as stated in the counter affidavit.

" It is further humbly submitted that as already stated above, the amount Rs.10,000/ - paid by the petitioner in his father's crop loan cannot be refunded because once amount credited in any loan account and if the same is closed it cannot be debited and paid back. The benefit of waiver of total liabilities including Rs.10,000/ - paid by the petitioner can be availed by the petitioner, after the Govt. of AP approves the waiver relief of two loans outstanding in the name of petitioner's father under AP Debt waiver scheme.

It is further humbly submitted that the petitioner in frequently in contact with this respondent while this respondent was working as senior branch manager at Ponnalur Branch and aware of all these steps taken by this respondent in compliance of the order of this Hon'ble court. Hence this respondent did not communicate the same to the petitioner in writing as the process is still pending with the competent authority to sanction waiver of crop loan."

In view of the stand taken by the respondent, counsel for petitioner requests the Court to close the Contempt Case. The Contempt Case is accordingly closed. No order as to costs.
