THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 19470 of 2004 ORDER:

The petitioners, twenty seven in number, assailed the action of the respondents in trying to resume the lands in their possession in different survey numbers of Minagallu Village, Buchireddypalem Mandal, Nellore District, by evicting them.

No interim orders were passed by this Court protecting the alleged possession of the petitioners. While so, a counter affidavit was filed by the Mandal Revenue Officer, Buchireddypalem, as long back as in November, 2004, denying the alleged possession of the petitioners and asserting that they were in no way concerned with the land. He further stated that the petitioners had been set up by an encroacher to file this writ petition. No reply affidavit was filed denying the counter affidavit averments. It is therefore clear that the petitioners are not interested in pursuing this writ petition.

The writ petition is accordingly dismissed for non-prosecution. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
