THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39461 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed to declare the continuation of the rowdy sheet against the petitioner, as illegal and arbitrary and consequently direct the respondents to take immediate measures to close the rowdy sheet against the petitioner. Heard and perused the material available on record. The case of the petitioner is that the 4th respondent originally registered Crime No.203 of 2003 against the petitioner for the offences under Sections 307, 341 & 427 IPC and subsequently, the police filed charge sheet and the petitioner was acquitted in the said case and the same has become final. The 4th respondent registered four other cases on the petitioner, in which three cases ended in acquittal and the fourth case ended in a compromise. The 4th respondent has opened a Rowdy Sheet against the petitioner.

The main grievance of the petitioner is that though the petitioner is acquitted and all the remaining cases ended in acquittal, the Rowdy Sheet opened against the petitioner is not closed and the petitioner is put to undue harassment by the 4th respondent and that the petitioner is frequently called by the 4th respondent to his office and bind over proceedings are being initiated frequently against the petitioner. Considering the grievance of the petitioner, the petitioner is directed to make a representation to the Commissioner of Police, Cyberabad Police Commissionerate, Gachi Bowli, Hyderabad (2nd respondent) informing that he is not involved in any other crime, but the 4th respondent recommended for continuation of the rowdy sheet opened against the petitioner. On such representation, the 2nd respondent is

directed to consider and dispose of the same, in accordance with law, as expeditiously as possible, within a period of one (1) month from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 2nd January, 2017 KL
