THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.14066 OF 2018 ORDER:

In this Writ Petition, under Article 226 of the Constitution of India, the only grievance of the petitioner is in respect of inaction of the police on the complaints said to have been filed by the petitioner on 15.02.2018, 16.02.2018 and 17.02.2018 and their failure to take appropriate action in accordance with the procedure established by law on the said complaints.

I have heard the submissions of Sri K.Venumadhav, learned counsel for the petitioner, and of the learned Government Pleader for Home (TG), appearing for the respondents 1 to 4. I have perused the material record.

At the hearing, learned counsel for the petitioner would submit that if a direction is given to the police officer concerned to take suitable action on the complaints of the petitioner, the grievance of the petitioner stands redressed. 4.

Learned Government Pleader for Home, on written instructions, dated 20.04.2018, a copy of which is placed on record, submits that on receipt of the complaint, dated 17.02.2018, an entry was made in the General Diary of the police station and thereafter, preliminary enquiry was also made; that the said enquiry revealed that the dispute is purely civil in nature and the photographs, which are filed with material papers, were taken at the time of performance of a pooja during Dasara festival; that having regard to the contents and nature of the complaint, the

police officer concerned is following the guidelines in Lalita Kumari Vs. Government of Uttar Pradesh1 and that he will take suitable further action as per the precedential guidelines in the said decision.

Learned counsel for the petitioner, in reply, would submit that if the police officer takes suitable action in accordance with the legal position obtaining, the ends of justice would be met. 6.

Recording the submissions, the Writ Petition is disposed of reiterating the guidelines of the Supreme Court in the aforestated precedent and directing the police officer concerned to take suitable action on the complaints lodged by the petitioner. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
