The petitioner/accused filed the present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS), seeking to grant pre-arrest bail to her in Crime No.72 of 2026 of Kondapur Police Station, Sanga Reddy District, which was registered for the offence punishable under Section 108 of the Bharatiya Nyaya Sanhita 2023 (BNS).

Heard Mr. Kasireddy Mohan Chandra Has, learned counsel for the petitioner and Mr. M.Vivekananda Reddy, learned Assistant Public Prosecutor appearing for the respondent-State.

The allegation against the petitioner is that she along with her husband quarrelled with the mother-in-law of de facto complainant and due to emotional distress, the mother-in-law committed suicide by consuming pesticide poison and died while undergoing treatment.

Learned counsel for the petitioner submitted that petitioner was falsely implicated in the case. It is alleged in the FIR that petitioner has abused mother-in-law of de facto complainant and she has committed suicide. However, the contents of the FIR do not disclose any words uttered by the petitioner and how such words have induced the deceased to commit suicide. 5.
On the other hand, learned Assistant Public Prosecutor opposed the grant of pre-arrest bail to the petitioner stating that specific allegations are levelled against her, and moreover, anticipatory bail application filed by the petitioner before the trial Court has been dismissed.

In view of the facts and circumstances of the case, taking into consideration the submissions of learned counsel for the
petitioner, this Court deems it fit to grant anticipatory bail to the petitioner/accused, this Court deems it fit to grant anticipatory bail to the petitioner/ accused.

Accordingly, this Criminal Petition is allowed and the petitioner/accused shall be released on anticipatory bail on the following terms and conditions:
i.
The petitioner shall surrender before the Station House Officer, Kondapur Police Station, Sanga Reddy District, within two (2) weeks from today and on such surrender, the said Station House Officer shall release her on bail on her executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m. and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
