THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6176 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking grant of anticipatory bail in crime No.35 of 2014 on the file of the P.S., Koyyuru, Visakhapatnam District, registered for the offence under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

Heard and perused the material available on record. Learned counsel for the petitioner submits that though the petitioner was granted anticipatory bail by this Court in Crl.P.No.15386 of 2014, by order dated 17.12.2014, he could not surrender before the SHO concerned within the stipulated time, as the petitioner was in judicial custody in another case. He further submits that now the police are trying to arrest the petitioner in the present crime and as such, prays this Court to grant anticipatory bail to the petitioner/A.1.

This Court is of the view that as the petitioner could not comply with the direction of this Court to surrender before the SHO concerned within the stipulated time, this Court is not inclined to grant anticipatory bail. The criminal petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 22.07.2015 pln
