HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1684 of 2016 ORDER:

This revision is preferred challenging the order dated 14.06.2016 passed in Crl.M.P. No.533 of 2016 in CC No.264 of 2016 in Crime No.5 of 2016, by the Judicial Magistrate of First Class, Mahabubnagar, wherein the learned Magistrate dismissed the application filed by the petitioner -to permit him to leave the Country and to go to Singapore.

Heard and perused the material available on record. The case in brief is that the petitioner is A1 in CC No.264 of 2016 for the offences under Sections 498-A IPC and 3 & 4 of the Dowry Prohibition Act. He approached this Court and obtained anticipatory bail. While granting anticipatory bail to the petitioner, this Court directed the petitioner not to leave the Country without permission of the Court concerned. When the petitioner filed Crl.MP No.533 of 2016 before the Court below to permit him to leave the country, the same was dismissed vide order impugned. Hence, this revision.

Learned counsel for the petitioner submitted that the petitioner is working in Singapore since several years and if he is not permitted to go to Singapore, he may lose his job and he will give an undertaking before the Court concerned to represent his case through his counsel and also he will appear before the Court concerned as and when his presence is required, and therefore, he may be permitted to leave the country.

Having heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and having perused the material

available on record, this Court is inclined to pass the following order: The petitioner is directed to file an undertaking before the Court below to represent his case through his counsel on all hearing dates and he will appear before the Court concerned as and when his presence is required and on filing of such undertaking, the Court below is directed to permit the petitioner to leave the Country. Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
