HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.16854 of 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader appearing for the respondents. The prayer sought in the writ petition is as under: "... to issue order or direction more particularly in the nature of writ of mandamus declaring the action of respondents Nos.2 and 3 in falsely implicating the petitioner in false cases and harassing the petitioner by way of repeatedly calling him to the police station and threatening him to implicate in the false cases and interfering into his private life and liberty as arbitrary, illegal and violation of Article 14 and 21 of Constitution of India and consequently direct the respondent Nos.2 and 3 not to implicate the petitioner in any false cases and not to interfere into his private life and liberty."
The main grievance of the petitioner is that respondent Nos.2 and 3 are falsely implicating him in criminal cases and harassing him by repeatedly calling to the police station and thereby interfering in his private life and liberty.
Learned Government Pleader placed on record the written instructions dated 18.06.2015 issued by the Sub-Inspector of Police, Vinukonda Police Station, Guntur district. A perusal of the said instructions would reveal that the petitioner is arrayed as accused No.1 in Crime No.80 of 2015 dated 12.05.2015 for the offence under Sections 189, 507 and 501 IPC and Section 66 (A) and (C) of I.T. Act, 2000. In that connection, the petitioner was arrested on 12.05.2015 and sent to judicial custody. Thereafter, he obtained bail. The petitioner also arrayed as an accused in Crime No.122 of 2015 for the offence under Sections 501 and 506 IPC and Section 66(A) and (C) of the I.T. Act on the file of the Chilakaluripeta Town Police Station.
In the written instructions, it is specifically stated that the respondent police are not falsely implicating the petitioner in criminal cases. They never threatened him and interfered in his personal life and liberty by calling him to the police station. It is further stated that the respondent police never sent any staff to the petitioner's house and there seems to be a civil dispute between the petitioner and one Madineni Anjeneyulu with regard to rice mills for which the respondent police are nothing to do with it. Taking the said submissions into consideration, this Court is of the opinion that no further orders are required in the writ petition.
Accordingly, the writ petition is closed. No costs. Miscellaneous petitions, if any, shall also stand closed. _____________________ P. KESHAVA RAO, J Date: 27.11.2018.
