THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7652 of 2016 ORDER:

This writ petition, filed under Article 226 of the Constitution of India, challenges the action of the 2nd respondent in not passing any orders on the appeal, dated 21-08-2013 preferred by the petitioner against the order of dismissal passed by the 3rd respondent on 30-07-2013.

Heard, Sri J. Prabhakar, learned counsel for the petitioner. While the petitioner was working as Assistant Manager in the respondent company the 3rd respondent herein passed an order, dated 30-07-2013 inflicting the punishment of dismissal from service.

Aggrieved by the said order of dismissal the petitioner herein preferred appeal before the 2nd respondent - appellate authority on 21-08-2013. The only grievance of the petitioner in the present writ petition is inaction on the part of the 2nd respondent in passing any orders on the said appeal filed by the petitioner. Having regard to the nature of controversy and in the facts and circumstances of the case, this Court is of the considered opinion that the ends of justice would be met if the 2nd respondent herein is directed to pass appropriate orders on the appeal, dated 21-08-2013 said to have been preferred by the petitioner herein against the order of dismissal, dated 30-07-2013 passed by the 3rd respondent by fixing some timeframe.

For the aforesaid reasons, the writ petition is disposed of, directing the 2nd respondent to pass appropriate orders on the appeal, dated 21-08-2013 preferred by the petitioner herein against the order of dismissal passed by the 3rd respondent on 30-072013, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
