THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8782 of 2015 ORDER:

This criminal petition, under sections 437 & 439 of the Code of Criminal Procedure, is filed by the petitioners-Accused Nos.1 and 2 seeking to grant bail in connection with crime No.132 of 2015-16 on the file of Prohibition & Excise Station, Eluru, West Godavari District, registered for the offence punishable under Section 8(c) read with 20(b) of the Narcotic Drugs and Psychotropic Substances Act. The case of the prosecution is that on reliable information, the Prohibition & Excise Police have arrested the petitioners for being in possession and transporting 132 kgs., of ganja at Kalaparru Toll Plaza of Pedapadu Mandal, West Godavari District in Tata Indigo Manza Car bearing Registration No.TN 60 R 1374.

Heard and perused the material available on record. A perusal of the record discloses that the seized ganja is about 132 kgs., which is more than the commercial quantity. Hence, this Court is not inclined to grant bail to the petitioners at this stage. Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J September 10, 2015 KTL
