THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4760 of 2016 ORDER:

The grievance of the petitioners was with regard to the failure on the part of the Regional Transport Authority, Nalgonda Town and District, State of Telangana, to receive their application for registration of two Buses bearing Nos.AP 24 X 6190 and AP 24 X 5605. The 2nd petitioner - School was stated to have purchased these Buses in a public auction conducted by Shriram Commercial Vehicle Finance. The complaint of the petitioners was that owing to the registration of Crime No.236 of 2011 on the file of Kodad Town Police Station, Nalgonda District, the transport authorities were refusing to proceed with the registration of the vehicles consequent upon the purchase of the same by the 2nd petitioner - School.

Sri Palle Nageshwar Rao, learned counsel for the petitioners, would assert that a final report was filed by the police authorities in relation to Crime No.236 of 2011 before the learned Judicial First Class Magistrate at Kodad referring the case as 'False'. A copy of the said final report is also placed on record. In the light of the afore-stated facts, this Court is not inclined to entertain the present writ petition at this stage and call for a counter. The writ petition is accordingly disposed of directing the Regional Transport Authority concerned at Nalgonda Town and District, Telangana State, to receive the application of the 2nd petitioner - School for registration of the subject vehicles and process the same in accordance with law.

The authority concerned shall be mindful of the fact that a final report was filed by the police authorities referring the case in Crime No.236 of 2011 on the file of Kodad Town Police Station as 'False'.

The authority concerned shall take action in the matter expeditiously and in any event not later than two weeks from the date of receipt of the application of the 2nd petitioner - School.
