HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 9957 of 2017 Order:

This Writ Petition is filed seeking a direction to the respondents 2 to 5 not to interfere with the practice of Acupuncture being done by the petitioners in Krishna District.

The case of the petitioners is that against the first petitioner FIR No.60 of 2016 was registered on 19.02.2016, on the basis of a complaint given by one Ramisetty Siva Krishna, by Tadepalli Police, Guntur Urban district and taking advantage of the registration of the said complaint, the respondents 2 to 5 are interfering with the petitioners practice and threatening them to close the practice.

This Court sees no material in support of the said apprehension. In the circumstances, it is open to the petitioners to bring the correct facts and legal position to the notice of the respondents 2 to 4 with regard to their right to practice and it is for the respondents 2 to 4 to consider the same and take appropriate action. This Court cannot interfere on the basis of mere apprehension.

The Writ Petition is, accordingly, disposed of giving such liberty to the petitioners. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
