K. Lakshmaiah v. Sri Sudha Finance Corporation
HON'BLE SRI JUSTICE A. SHANKAR NARAYANA C.C.C.A.No.162 of 2000 JUDGMENT :
Ms. B. Sapna Reddy, counsel, representing Sri K.V. Reddy and Smt. B. Niraja Reddy, learned counsel for the appellant, would submit that the sole appellant died in the year 2002 and the Death Certificate of the deceased - appellant is available in their case bundle, which is not with her now, and the legal representatives of the deceased - appellant have not been approaching them to take necessary steps, in that regard.
2.
Of-course, reporting the death of the sole appellant by way of a Memo has not occurred in this case, when the death of the sole appellant had taken place in the year 2002 itself, as per the representation made by the learned counsel. 3.
However, for not bringing the legal representatives of the deceased - appellant on record within the time-frame, as per the mandatory provisions of C.P.C., the instant appeal stands dismissed as abated.
4.
As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
