All these Writ Petitions were filed challenging the surcharge orders issued by the fourth respondent and non-consideration of the interlocutory applications filed in the pending appeals against the said surcharge orders by the seventh respondent.

At the time of filing the present batch of Writ Petitions, there was a doubt with regard to continuance of the seventh respondent as it was contemplated to transfer the files from the seventh respondent to the eighth respondent. In the meanwhile, the Deputy Registrar of Co-operative Societies issued a distraint order and, in those circumstances, the distraint order was suspended initially for a period of six weeks and it was being extended from time to time. Now the learned Government Pleader, on the basis of written instructions, submits that the seventh respondent is functioning. There is no dispute that the appeals were already preferred against the surcharge orders and they are pending before the seventh respondent. In the pending appeals, the petitioners also filed interlocutory applications seeking stay.

In the circumstances, all the Writ Petitions are disposed of continuing the stay with regard to distraint orders for a period of thirty

(30) days from the date of receipt of a copy of this order in order to enable the petitioners to obtain appropriate orders in the pending interlocutory applications in the appeals pending before the seventh respondent. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in these Writ Petitions, if any, shall stand closed.
