THE HON'BLE SMT JUSTICE ANIS CRIMINAL PETITION Nos.14190 of 2016 O R D E R:

The second respondent lodged a complaint with the police, Malakpet against the petitioner/A.2 and another person for the offences punishable under sections 406 & 420 IPC.

The learned counsel for the petitioner contended that though the name of the petitioner is arrayed as A.2, there are no specific allegations leveled against the petitioner and petitioner is innocent and not committed any offence. On the other hand, accused No.1 and second respondent entered into an agreement with M/s.Akshaya Infra and Properties and prayed the Court to restrain the police from arrest of the petitioner.

Heard the Public Prosecutor who stated that investigation in this case is not yet completed. Considering the facts and circumstances of the case, this Court cannot interfere with the investigation of the police in this case. But, alternatively this Court directs the police not to arrest the petitioner till the completion of investigation and filing of the report into the Court.

With this observation, the criminal petition is disposed of. Miscellaneous petitions pending if any in this criminal petition shall stand closed.
