ORDER
This Criminal Petition is filed praying this Court to enlarge the petitioners on bail who are arrayed as accused No.1, 3 and 5 in Crime No.154 of 2026 before the Chatrinaka Police Station, Hyderabad, registered for the offence
punishable under Sections 308(2), 109(1) read with 3(5) of BNS.

The brief facts of the case are that on 13.03.2026, the complainant Chandaliya Bhavesh, along with his friends Ankit Singh and Aditya Singh, visited Shah Darbar Hotel at Falaknuma, where an altercation broke out between Aditya Singh and another individual. Subsequently, a group of persons attacked them. While attempting to escape, the complainant's motorcycle keys were snatched. Later, near Aliabad Jhanda, the group intercepted them again, assaulted them, and one person allegedly hit the complainant on the head with an iron rod, causing injury, and also attacked Ankit Singh. The assailants then took away the complainant's motorcycle and fled.

Heard Sri K. Satish Chakravarthy, learned counsel appearing on behalf of the petitioners as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.
Learned counsel for the petitioners submitted that the petitioners have been falsely implicated and denies their
involvement in the alleged assault, particularly the use of the iron rod and that even as per the complaint, only one individual caused the injury, and there was a mutual altercation between both sides over a trivial issue. The investigation is substantially complete, including the Test Identification Parade. Therefore, he prayed the Court to grant bail to the petitioners by allowing this Criminal Petition. 5.
Learned Additional Public Prosecutor would contend that the allegations disclose a serious offence involving a group attack, use of a deadly weapon, and causing injuries, along with theft of the motorcycle and that the role of the petitioners cannot be ruled out at this stage, especially given their presence in the unlawful assembly, and that their release may affect the course of the investigation or influence witnesses. At this stage, granting of bail to the petitioners does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioners are in jail since 13.03.2026. As seen from the record, the material part of the
investigation has been completed and L.Ws.1 to 16 witnesses have been examined.
Considering the facts and circumstances of the case and the incarceration period of the petitioners, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.
The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the Chief Judicial Magistrate, Nampally, Hyderabad.
ii.
The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioners shall abide by the conditions stipulated in Section 437(3)
of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
