THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.4748 OF 2018 ORDER:

This petition is filed by the petitioners-A3 to A7 under Section 482 Cr.P.C. to quash the proceedings in S.C.No.145 of 2017 on the file of the SC/ST Court-cum-VI Addl. District and Sessions Judge, Kurnool, wherein cognizance was taken for the offences punishable under Sections 323 and 506 r/w 34 IPC and 3 (1) (s) of SC/ST (PoA) Amendment Act, 2015.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

In the course of submissions, it is brought to the notice of this Court that no discharge application is filed by the petitioners. There is efficacious remedy available to the petitioners to file discharge application before the Court of Session when charges are not framed. In the event of petitioners filing an application for discharge, the Court below may dispose of the same on merits in accordance with law, without being influenced by the proceedings instituted before this Court.

With the above observation, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this petition shall stand closed.
