HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4650 of 2019 O R D E R :
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 is filed by the petitioners, who are A.1 to A.5, for grant of anticipatory bail in the event of their arrest in Crime No.144 of 2019 of Chevella Police Station, Cyberabad, Ranga Reddy District, registered for the offences punishable under Sections 307, 504, 147 and 148 r/w. Section 149 of IPC.
The case of the prosecution is that while the injured was coming from Chevella to Kandavada, near cross road at Sheri Buchireddy Kirana Shop, all the accused persons attacked him with iron rods, bats and sticks and assaulted him and caused grievous injuries.
Heard learned counsel for the petitioners/A.1 to A.5 and the learned Additional Public Prosecutor appearing for the respondent-State. Perused the material on record. Learned counsel for the petitioners contends that the petitioners are innocent of the alleged offences and they have been falsely implicated in the above crime with a political motive. It is also contended that entire investigation in the above crime is completed and the petitioners are ready to abide by any conditions imposed by this Court, including assisting the investigating agency for their release on
GSD, J Crl.P.No.4650 of 2019 anticipatory bail in the event of their arrest in the above crime.
On the other hand, the learned Additional Public Prosecutor opposed the relief sought in the above petition. As seen from the contents of FIR, there are specific allegations against the petitioners that all the accused attacked the injured and assaulted him with iron rods, bats and sticks and caused grievous injuries by scolding him in filthy language as to how he could complain against them and accordingly tried to kill him. In view of the specific nature of allegations levelled against the petitioners and gravity of offences, I am not inclined to grant anticipatory bail to the petitioners. However, if the petitioners/A.1 to A.5 surrender before the Court below concerned and move an application for regular bail, after giving prior notice to the Public Prosecutor concerned, the said application may be considered in accordance with law.
With the above observations, this Criminal Petition is dismissed.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
