THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.19854 OF 2016 ORDER:

The writ petition is filed challenging the action of the respondents 2 to 5 in not registering the crime against the respondents 6 to 17 for interfering and trespassing into the petitioner's land. This Court, by order, dated 22.06.2016, directed the respondents not to interfere except following due process of law. Learned counsel appearing for the respondents 15 to 17 submits that taking advantage of the said order, the official respondents are interfering with the possession in order to help the petitioner. But the learned Government Pleader, on the basis of written instructions, submits that pursuant to the complaint filed by the petitioner on 09.06.2016, crime No.85 of 2016 was registered on 13.06.2016 and investigation was taken up. It is also assured that the investigation will be completed as expeditiously as possible. The said instructions were issued on 30.06.2016.

In view of the said instructions, liberty is given to the fifth respondent to complete the investigation, if not already completed, and file final report, pursuant to the investigation, as expeditiously as possible, preferably within a period of two months from the date of receipt of copy of this order. If there is any threat of interference either by the official respondents or by the unofficial respondents, it is open to the petitioner to work out remedies in the competent civil Court in accordance with law. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 21.03.2017 pln
