When the present appeal was called on 31.01.2018, since, there was no representation for the appellant, the Registry was directed to list the present appeal under the caption 'for dismissal.'

2. Today also, there is no representation for the appellant. It appears that the appellant is not inclined to prosecute the present appeal.

3. In fact, the present appeal was dismissed against respondent No.2 for default on 14.09.2006. No steps were pursued by the appellant to get the said dismissal order set aside.
