HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.No.5687 of 2015 ORDER:

This Criminal Petition is filed Under Section 482 Cr.P.C. by the Petitioners-A1 to A4 to quash the proceedings initiated against them in Crime No.103 of 2015 of Narayankhed Police Station, Medak District, registered for the offences punishable under Sections 406, 409, 420 and 120-B read with section 34 I.P.C.

A private complaint was filed by the 2nd respondent herein against the petitioners-A1 to A4 alleging the aforesaid offences before the Court of the Judicial Magistrate of First Class, Narayankhed, and it was referred to the police under Section 156 (3) Cr.P.C. for investigation and report. Thereafter, the police registered the complaint as a case in Crime No.103 of 2015 against the petitioners-accused under the aforesaid offences and took up investigation. The present petition has been filed for quashing of the same. Heard the learned Counsel appearing for the petitioners and the learned Public Prosecutor, representing the State, and also the learned Counsel for the 2nd respondent.

The allegations in the complaint prima facie reveal the commission of alleged offences by the petitioners-accused. This is a matter, which requires investigation by the police. Therefore, I see no grounds to interfere at this stage with the investigation of the case.

Having regard to the aforesaid facts and circumstances of the case, the Criminal Petition is disposed of with a direction to the Investigating Officer to proceed with the investigation expeditiously, however, he shall scrupulously follow the procedure as contemplated under Section 41A Cr.P.C before taking any coercive steps against the petitioners-A1 to A4.

Miscellaneous petitions, if any, pending shall stand closed.
