The petitioner/accused filed the present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) seeking to grant anticipatory bail to him in FIR No.225 of 2026 of Khammam II Town Police Station, Khammam District, which was registered on 17.04.2026 for the offences punishable under Section 64 of the Bharatiya Nyaya Sanhita, 2023 (BNS), 3(1)(r)(s)w(ii), 3(2)(v)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Heard Mr. Phanindra Pavan Kashyap, appearing for Mr. Sudarshan Malugari, learned counsel for the petitioner; and Mr. M.Vivekananda Reddy, learned Assistant Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is working as a bank employee and he is no way concerned with the allegations made by the de facto complainant. The de facto complainant has made several allegations which are not substantiated. Learned counsel has drawn the attention of this Court to the online transactions wherein the mother of the de facto complainant has transferred a sum of Rs.50,000/- (Rupees fifty thousand only) to the petitioner for the purpose of insurance and the same was also returned by the petitioner.

Further, with regard to the alleged incidents happened in the month of January, 2026 wherein the de facto complainant has alleged that the petitioner has abused her and her mother in the name of caste, learned counsel has drawn the attention of this Court to the car lease agreement where under the petitioner has taken a car on lease to travel to Goa, and also the online transactions made between the petitioner and the car rental services to demonstrate that he was not in Khammam at the relevant point of time. Therefore, the allegation made by the de facto complainant is false and frivolous. It is also submitted that though the alleged incidents have happened in the months of June and August 2025 and January 2026, the complaint was given only in the month of April 2026.

Learned counsel for the petitioner submitted that the petitioner is ready to cooperate with the Investigating Officer and he apprehends arrests in the meantime.

Though notice was issued to the victim through Police, there is no appearance on her behalf.

On the other hand, learned Assistant Public Prosecutor vehemently opposed the grant of pre-arrest bail to the petitioner stating that allegations levelled against his are serious in nature. With regard to the delay in filing the complaint, the de facto complainant was of the fond hope that the petitioner would marry her, as such, she did not file the complaint immediately. 6.

However, having regard to the fact that the petitioner was not in Khammam during the month of January 2026 as evident from the material on record and the allegations made by the de facto complainant with regard to such incidents appear to be incorrect and thus, doubt arises on the other averments of the complaint.

Accordingly, this criminal petition is allowed and the petitioner shall be released on anticipatory bail on the following terms and conditions: i. The petitioner shall surrender before the Station House Officer, Khammam II Town Police Station, within two (2) weeks from today and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii. The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case. iii. The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m. and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required. iv. The petitioner shall not contact the victim/de facto complainant or her family members in any manner.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
