THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12685 of 2015 ORDER:
This Criminal Petition is filed by the petitioner-Accused No.1 under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in Crime No.832 of 2015 on the file of KPHB Police Station, Ranga Reddy District, registered for the offence punishable under Sections 302 and 201 IPC.
Heard and perused the material available on record. In the present case, a complaint was received on 9.9.2015 from the brother of the deceased. It is stated that the deceased informed the complainant over phone on 7.9.2015 that he was compelled by the petitioner and others to take alcohol from the morning. Thereafter, when the complainant tried to contact the deceased, he could not be able to contact him. Hence, the complainant lodged a complaint suspecting some foul play. On the basis of the complaint, the police started investigation and during the course of investigation, one TV News Channel reporter handed over the accused and stated that the petitioner confessed his role in commission of murder of the deceased. On the basis of the extra judicial confession, the police investigated the case and recovered some material objects used in commission of the offence.
Learned Public Prosecutor submitted that the investigation is at the early stage.
Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, the Criminal Petition is dismissed. _____________________ JUSTICE RAJA ELANGO Dated: 08.12.2015 Nn
