THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16560 of 2019 O R D E R:
This Writ Petition is filed for the following relief: "....to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent by issuing a short fall letter and not granting building permission to the petitioner herein vide Lr.No. 2/C20/03863/2019 dated 04.03.2019 as illegal, irregular, unjustified, arbitrary, unconstitutional and unsustainable and consequently direct the 3rd respondent to issue the building permission to the petitioner herein for land situated at Plot No.263, admeasuring 500 Sq. yds for construction of stilt plus 4 upper floors in Sy.No.
66/2, in Raidurg Nowkhalsa Village, Serilingampally Mandal, Ranga Reddy District and pass such an order or orders as this Honourable Court may deems fit and proper in the circumstances of the case and consequently direct the 3rd respondent to issue the building permission without insisting upon the NOC from the 5th respondent (i.e., the competent authority) ...." When the matter is taken up, it is submitted by the learned counsel for the petitioner as well as learned Standing Counsel for respondent Nos.2 and 3 that the issue raised in the present Writ Petition is squarely covered by the order dated 02.04.2019 passed by this Court in Writ Petition No.6061 of 2019.
Relevant portion of the aforesaid order reads as under: "Having regard to the respective submissions, more particularly the submission of the learned counsel for the petitioner that the respondent authorities have granted permission in the case of Plot No.
within a period of four weeks from the date of receipt of a copy of this order.
The writ petition is accordingly disposed of. " Following the aforesaid order and for the reasons stated therein, this Writ Petition is also disposed of in terms thereof.
