THE HON'BLE THE ACTI NG CHI EF JUSTI CE RAMESH RANGANATHAN WRIT PETITION No.17035 of 2008 ORDER:

The relief sought for in this writ petition is to declare the action of the respondents, in trying to dispossess the petitioners from their lands, as arbitrary and illegal. Consequential relief is sought to direct the respondents not to interfere with the possession of the petitioners, in respect of the said lands, without following the procedure established by law.

While ordering notice before admission this Court, by order dated 06.08.2008, directed the respondents not to interfere with the subject lands, without following due process of law. As the petitioners' interests are adequately safeguarded by the interim order, it would suffice to make the interim order, the final order in the writ petition. 3.

The respondents shall not evict the petitioners from the subject lands, except after putting them on notice and after giving them the opportunity of being heard. The Writ Petition stands disposed of accordingly. There shall be no order as to costs. 4.
