HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29578 OF 2017 ORDER:
This writ petition is filed declaring the action of the 3rd respondent in issuing show cause notice dated 23.08.2017 vide proceedings No.E2/114(02)/2017-HNK, removing the petitioner from service, as illegal and arbitrary. The case of the petitioner is that petitioner was declared as unfit for the post of driver by the Medical Officer, RTC Dispensary, Warangal vide MC.No.0/204937 dated 30.10.2013. Subsequently, he was appointed as Shramik. The only dispute is with regard to the endorsement made by APSRTC Hospital, Tarnaka declaring the petitioner as unfit to A1 category and rejection of appeal. It is stated that this document was straight away sent to respondent authorities by the hospital authorities and petitioner has no role to play in respect of the said endorsement.
Heard learned counsel for petitioner who submits that petitioner has nothing to do with the allegation in show notice, as such the same has to be quashed.
Sri Mayur Reddy, learned Standing counsel for TSRTC submits that it is only a show cause notice and the petitioner can file explanation to the same.
In view of the above, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition
seeking liberty to raise all the grounds raised herein, by way of filing reply to the impugned show cause notice. Granting liberty as prayed for, this writ petition is dismissed as withdrawn.
