On 28.02.2009 recruitment notification No.3/2009 was issued by Osmania University to fill up post of Assistant Professor in Education, meant for Scheduled Tribe category candidates in backlog vacancies. Petitioner participated in the selections. According to the petitioner, entire selection process was completed and just before the appointment orders to be issued, Government by letter dated 24.07.2014 directed the Registrar, Osmania University to stay the recruitment process of Assistant Professors in the Department of Education. Aggrieved by grant of such stay by the Government and in delaying to complete the selection process, this writ petition is filed.

Counter-affidavit is filed on behalf of third respondent. Along with the counter-affidavit, letter of the Government dated 02.l1.2016 is enclosed. By this letter, Government informed the Vice Chancellor that he can proceed with the selection process and complete the same and directed to implement the orders of the Court dated 21.04.2014 in W.P.No.33272 of 2013. 3.

It may be relevant to note that one of the candidates, who participated in the selections, instituted W.P.No.33272 of 2013 challenging the selection process. This Court by order dated 21.04.2014 disposed of the said writ petition. The Court refused to interfere with the selection process. However, Court observed that, "this Court does hope that the authorities will take into account all

aspects and procedural parameters not to speak of the statutory regime in selecting the fittest candidate to the post in question, including the aspect of providing exemption to fourth respondent (G.Sridevi) when persons with clarification are already in the fray." Since the earlier stay granted by the Government is now rescinded, there is no impediment to the University to complete the selection process by duly taking note of the observations made by this Court in W.P.No.33272 of 2013.

At this stage, learned Special Government Pleader, Sri Andapalli Sanjeev Kumar, submits that University requires eight weeks time to complete the selection process. 5.

Recording the said submission, writ petition is disposed of, directing the University to complete the selection process to the post of Assistant Professor in Education meant to be filled up by Scheduled Tribe candidates within a period of eight weeks from the date of receipt of copy of this order duly taking note of the directions of this Court in W.P.No.33272 of 2013. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ JUSTICE P.NAVEEN RAO kkm
